Terms of Use


The information accessed via the Agent Area, including the Agent Area website, is privileged, confidential and proprietary to McNeil & Company, Inc.

As a condition to furnishing you with Agent Area functionality and information, you agree that the Agent Area website and the information which McNeil furnishes to you or your representatives or which you or your representatives obtain through the Agent Area access (collectively, the "Agency Reports" and "Insured Reports") will be kept confidential. Confidential Information does not include policies, endorsements and any other items that in the sole discretion of McNeil will not be considered confidential in the future. In addition, you warrant that any person who is using the Agent Area website and has access under your agency’s login understands the terms and conditions of this Agreement.

You agree that the Agent Area website and its information will not be used by you, your employees, affiliates, or your representatives (collectively, your "representatives") in any way detrimental to McNeil. Any and all reports produced in the Agent Area website and information contained in said reports shall not be used for any other purpose than for doing business with McNeil. The Agent Area website and its confidential information will be treated as belonging to McNeil, and shall not, without our prior written consent, be disclosed in any manner, in whole or in part, to anyone who is not one of your affiliates or representatives.

If McNeil’s agreement with you is terminated for any reason, you agree to destroy all reports generated from Agent Area website without retaining any copies. You agree not to use the confidential information or disclose the confidential information for a period of five years after the termination of the underlying agreement.

No failure or delay by McNeil in exercising any right, in whole or in part shall operate as a waiver of any other right. This Agreement shall be governed by the laws of the State of New York and any legal action with regard to this agreement shall be brought in the Supreme Court of the State of New York, Cortland County. It is further understood and agreed that money damages may not be a sufficient remedy for any breach of this Agreement by you and that McNeil shall also be entitled to specific performance as a remedy for any such breach. These remedies shall not be deemed to be the exclusive remedies for your breach of this Agreement, but shall be in addition to all other remedies available at law or equity to McNeil.

Do not use the Agent Area website until you have carefully read, understand and agree to the terms and conditions of this above Agreement. By accessing the Agent Area website (or authorizing any other persons to do so) indicates your acceptance of the terms and conditions contained in this Agreement. If you do not agree with the terms and conditions of the Agreement, promptly notify McNeil & Company and we will terminate access.
